HB 1171 by Rep. David Simpson (R-Longview) would impose civil liability on an electric utility or a transmission and distribution utility for personal injury, property damage, or death arising out of the use of an “advanced” or smart meter. The bill defines “property damage” to include an invasion of personal privacy and any pecuniary harm caused by the loss, misuse, or theft of customer data acquired by the use of a smart meter. In addition, a utility must allow a customer either to decline, without charge, to have a smart meter installed or, if a meter has already been installed, to have the meter removed. The utility must also notify each customer of these options.
