Texas House Committee on Environmental Regulation

Please attend the hearing and sign 3 separate cards in support of HB 1113, HB 1247, and HB 1865, or send a representative to do so.  These bills are major components of the League’s 2015 Legislative Program, and will be heard Tuesday morning.

Support HB 1113 by Clardy – Standing in Contested Cases.  Codifies case law with respect to TCEQ’s discretion to grant or deny standing for “affected parties” in a contested case hearing.

Support HB 1247 by Smith, W. – Procedures in Contested Cases.  Require protesting party to present specific evidence to rebut prima facie showing that a draft permit complies with applicable legal and technical requirements.

Support HB 1865 by Morrison – Contested Case Reform.   Provides a predictable timeline for the permitting and contested case process; codifies recent court decisions affirming TCEQ discretion to determine who is an affected party in a contested case; establishes that a draft permit issued by TCEQ has been through a very thorough review process and therefore meets legal, technical, public health and environmental requirements.

Support SB 709 by Fraser – Contested Case Reform.  Provides a predictable timeline for the permitting and contested case process; codifies recent court decisions affirming TCEQ discretion to determine who is an affected party in a contested case; establishes that a draft permit issued by TCEQ has been through a very thorough review process and therefore meets legal, technical, public health and environmental requirements.
