S.B. 632 (Bill Monning-D) is scheduled to be heard in the California Assembly Judiciary Committee on June 14, 2017.  The bill would limit the deposition of a deponent in asbestos litigation to seven hours of total testimony when a physician attests that the deponent is either over 70 years of age and the deponent’s health is such that a deposition of more than seven hours will prejudice the deponent’s well-being, or that, without regard to age of the deponent, the deponent suffers from an illness or condition that raises substantial medical doubt of the survival of the deponent beyond six months.  An additional seven hours of deposition testimony can be authorized if it is found that it does not endanger the health of the deponent.  The Civil Justice Association of California (CJAC) has offered amendments that would allow exemptions for case management orders and cap the provisions of the bill to instances when there are five or less defendants. Those amendments have thus far been rejected.
