Senator Bob Deuell has requested an opinion from the Attorney General regarding S.B. 321, the “guns in the parking lot” legislation enacted in 2011. Specifically, the request asks whether the provision in S.B. 321 that allows an employer to ban firearms or ammunition on any property where possession of the firearm or ammunition would violate state or federal law applies: (1) when the employee has a concealed handgun license issued under state law; or (2) when the employer claims that federal laws, such as the Maritime Transportation Security Act or the Chemical Facility Anti-Terrorism Standards, pre-empt SB 321. Interested parties have been invited to submit briefing to the Attorney General on one or both of these questions.
