SB 349 by Sen. Robert Nichols (R-Jacksonville) and Rep. Brandon Creighton (R-Conroe) passed to engrossment in the House yesterday. The bill clarifies the difference between a transmission line and distribution line for purposes of compliance with height requirements prescribed by national electrical safety standards. SB 349 responds to a 2012 Texas Supreme Court decision in Traxler v. Entergy Gulf States, Inc., which held that the height of distribution lines is governed by state law rather than the national standard. The decision thus cast a cloud over the compliance status of thousands of miles of distribution lines across the state. TCJL, an amicus brief in Traxler, supports this legislation.
