Legislation was filed on Friday to raise the age of minority for purposes of imposing liability on a person who serves alcohol to minors. Under current Texas law, an adult 21 years of age or older  is liable for damages proximately caused by the intoxication of a minor under 18 years of age if the adult knowingly provided any alcoholic beverage to the minor that contributed to the intoxication or allowed the minor to be served on the adult’s owned or leased premises. (The statute does not apply if the adult is the minor’s parent, guardian, or spouse, or if a court has awarded custody of the minor to the adult). HB 770 by Rep. Susan King (R-Abilene) raises the age of minority from under 18 to under 21.
