Legislation establishing a procedure for the dismissal of inactive asbestos and silica claims passed the Senate earlier today and is on its way to the Governor. HB 1325 by Rep. Doug Miller (R-New Braunfels) and Sen. Robert Duncan (R-Lubbock) clears the way for asbestosis and silicosis claims for which compliant medical reports were never filed to be dismissed, subject to refiling in the future under the law as it existed prior to September 1, 2005 (when the medical criteria took effect).
