Sen. Charles Perry

Sen. Charles Perry (R-Lubbock) has filed legislation that would prohibit a city or county from adopting or enforcing an ordinance or regulation requiring lessors of housing accommodations to accept federal housing choice vouchers in lieu of rent. SB 267 would allow the lessor to refuse to lease housing to a person because of the person’s lawful source of income to pay rent, including federal vouchers. Some cities have enacted or proposed ordinances that impose liability on lessors who refuse to lease based on the applicant’s source of income to pay rent. As currently drafted, the bill would apply both to ordinances currently in effect and future ordinances.
