Rep. Jim Keffer
Rep. Jim Keffer, Chair of the House Natural Resources Commission, has filed proposed legislation prohibiting a municipality from accepting a petition for a referendum or holding an election to enact or repeal an ordinance or charter provision, if the effect of the enactment or repeal would restrict the right of a person to use or access the person’s private property for economic gain. HB 2595 also gives a property owner the right to injunctive relief against the city to enforce this provision. As currently drafted, the bill applies prospectively only, so it would not affect the current status of the Denton fracking ordinance.
