Today the Texas Supreme Court granted rehearing in Eagle Oil & Gas Co. v. TRO-X, L.P. (No. 19-0983). The Court previously denied the petition for review in March, but has now reinstated the petition and set oral argument for December 1. In May TCJL filed an amicus brief requesting the Court to take another look based on our concerns about the effect of the Dallas Court of Appeals’ decision on the principle of claims preclusion. As you may recall from our previous post on the case, the central issue is whether the plaintiff violated that principle when it refiled the case in another county after receiving an adverse decision in a Midland district court. The case involves a limitations issue that requires review as well. We applaud the Court for granting rehearing and will closely follow the case in the months to come.
